En el presente artículo analizamos al menor como justiciable y su relación con el derecho de tutela judicial efectiva. Nuestra hipótesis es que se deben entrelazar el interés superior del menor con el derecho de tutela judicial efectiva para garantizar materialmente ambos derechos en la jurisdicción familiar. Encontramos que el principio de racionalidad y el uso de ponderación, sirven para la protección y desarrollo de ambos derechos fundamentales en la función jurisdiccional.
