TOWARDS AN INTRA-SYSTEM THEORY OF JUDICIAL ACTIVISM

In this paper, I advance the basis for an intrasystemic thesis of judicial activism. This thesis claims that judicial activism can be explained by resorting to a combination of structural elements of legal systems such as their formal properties and the interpretative codes contained in them. Under this approach, the activist judge can base her decision on legal grounds albeit it is the result of the exercise of her axiological preferences.
