Abstract

The creation of the National Anti-Corruption System (SNA) brought with it the implementation of various instruments aimed at the prevention, detection and sanction of administrative offenses and acts of corruption, among which the Integrity Policy was found. This instrument, like the SNA in general, has faced an adaptation process where the implementing agents have seen the need to resolve, without any precedent, the issues inherent to its implementation, such is the case of the Municipality of San Pedro Garza Garcia, Nuevo Leon. Given that the Integrity Policy is applicable to legal entities, this paper seeks to identify issues related to its implementation in public procurement and contracting in the State of Nuevo León. These are divided into two branches: public sector and private sector, and in each one the areas of opportunity will be indicated. Finally, in order to harmonize the implementation of the instrument in question, a reform to the Law of Acquisitions, Leases and Contracting of Services and to the Law of Public Works for the State and Municipalities, both of the State of Nuevo León, is proposed.
