Abstract

In this article, the origin and evolution of constitutionalism are analyzed, starting from the bourgeois revolutions of the 18th century. On the one hand, American constitutionalism is examined, born out of the North American Revolution of 1776, along with its main characteristics. On the other hand, European constitutionalism, originating in France with the revolution of 1789, is scrutinized, and a comparison of both constitutional models is made. Subsequently, the study delves into neoconstitutionalism, a product of the failure of the French constitutional model following the Second European post-war period in the 20th century. Finally, the emergence of autonomous constitutional bodies is analyzed as a reconsideration of the classical theory of the separation of powers, based on the introduction of the social functions of the State.
