La diferencia substancial de los principios como mandatos de optimización, es un tema de trascendencia por ser el sustento de la Teoría de los Principios de Alexy. De dicho presupuesto, se deriva la justificación y efectividad del Principio de Proporcionalidad, que es el método para interpretar los contenidos constitucionales y resolver los problemas que se plantean en la justicia constitucional. El presente artículo aborda la distinción entre reglas y principios, distinguiendo la diferencia cualitativa que resulta de identificar los principios como mandatos de optimización, posición que se confirma al describir las diferentes objeciones a la distinción, en contraste con los argumentos que las refutan. En ese contexto, se sostiene la validez de la distinción entre principios y reglas, por lo que nos adherimos a la tesis de la conexión entre la teoría de los principios, incluyendo al principio de proporcionalidad, y los derechos fundamentales.
