El objetivo de este trabajo es exponer ciertas reflexiones relevantes sobre el estado de la litigación climática en el planeta, como una herramienta para enfrentar la actual crisis del clima. El texto reflexiona sobre cuestiones previas de justiciabilidad, consideraciones de interés desde el derecho internacional, consideraciones de interés desde el derecho constitucional, temas de agravio, molestia o negligencia ilegal, reflexiones sobre leyes y política pública nacional, y aproximaciones o enfoques mixtos. El trabajo concluye con una breve sección de conclusiones (ya que cada sección presenta sus propios hallazgos), y una sección de referencias bibliográficas. En términos muy generales se puede observar que la litigación climática es un fenómeno reciente en derecho nacional e internacional. También que presenta características propias que tensan el derecho vigente tradicional. Y, finalmente,
