El presente artículo tiene como objeto el examen de la jurisprudencia emitida por la Sala Superior del Tribunal Electoral del Poder Judicial de la Federación, la cual, desde sede judicial, ha ampliado los supuestos de procedencia del recurso de reconsideración al margen de los previstos por la ley, rectificándolo como un recurso efectivo erigido con base en un activismo judicial. * Diversos planteamientos realizados en este trabajo forman parte de la tesis doctoral que se encuentra elaborando el autor a efecto de obtener el Grado de Doctor en Derecho por parte de la Universidad de Monterrey.
