Este trabajo tiene por objeto analizar la figura jurídica denominada estado de cosas inconstitucional (ECI), una creación normativa jurisprudencial de la Corte Constitucional Colombiana, que tiene efectos inter comunis a partir de la protección de los derechos fundamentales de personas pertenecientes a una misma comunidad o que tienen en común la afectación de los mismos derechos fundamentales derivada de una vulneración sistemática y permanente de estos. Para tal fin, revisaremos la aplicación de esta norma jurídica implícita en cuatro sentencias en las que la Corte Constitucional colombiana ejerce como dinamizador de la interpretación constitucional bajo el amparo de ser la garante de la estructura y contenido normativo de la Constitución Política, a pesar de lo controvertido que puede resultar la aplicación del ECI, especialmente en lo que atañe a las competencias y límites formales que debe observar esta Corte para establecer con claridad su competencia frente a la posibilidad de desequilibrar el sistema de pesos y contrapesos.
