THE GUARANTEE OF RESTORATION OF MOTHER EARTH AND ITS APPLICATION WITHIN BOLIVIAN LAW

The evolution of environmental law towards an ecological right, generated new principles focused on the integral protection of life as a common element, one of them is the principle of restoration of Mother Earth, arranged within the Bolivian positive system, which allows us to recognize to restoration as a series of actions translated into short, medium and long term plans in a specific area, where there was human intervention that negatively and deliberately altered an ecosystem, with the intention of returning nature to a state similar to that was found before the degradation, to restore the functionality of nature in the ecological, social, cultural and economic dimensions, without exempting from responsibility and sanction for the type of affectation caused. This principle is applied in a practical way mainly through the Environmental Restoration and Adaptation Plans generated within the Bolivian environmental management, which are developed in the present work, exposing mechanisms of the current legislation for the correct application of the principle.
